Terms of Service

These Terms of Service ("Terms") govern your access to and use of Ardhi Smart Metermobile apps, websites, APIs, customer console, and related prepaid metering services (the "Service"). By using the Service you agree to these Terms and our Privacy Policy.

1. The Service

Ardhi Smart Meter provides tools for prepaid electricity customers and utility operators, including account login, meter linking, mobile money top-up, credit / token delivery, usage monitoring, remote Light and Main switch controls (where enabled), alerts, and analytics. Features may vary by meter firmware, utility configuration, and network connectivity.

2. Eligibility and accounts

  • You must provide accurate registration details and keep your phone number and email up to date.
  • You are responsible for safeguarding login credentials and OTP codes sent to your phone.
  • You may only use a meter number you are authorised to manage. Linking or controlling another customer's meter without permission is prohibited.

3. Payments and prepaid credit

  • Top-ups are processed through third-party payment providers (for example mobile money). Approval on your phone / wallet is required for successful payment.
  • Credit (kWh) is applied according to the active tariff and successful payment confirmation. Delivery to the physical meter may depend on the device polling the server and network conditions.
  • Minimum purchase amounts and rates are shown in the app before you pay. Taxes or operator fees may apply as required by law or your payment provider.
  • Failed, cancelled, or delayed payments are handled according to the payment provider's rules and our transaction records. Contact support with your order / meter number if credit does not appear within a reasonable time after a successful payment.

4. Meter control and utility actions

  • Where enabled, you may remotely control Light and Main switches independently. Commands apply when the meter next communicates with the server.
  • The utility may apply a remote service cutoff or other operational actions for safety, debt, maintenance, or policy reasons. While cutoff is active, turning supply on from the app may be blocked.
  • You are responsible for safe use of remote switching (for example not cutting power in unsafe situations). We are not liable for damage arising from remote commands you or authorised admins initiate, except where required by applicable law.

5. Acceptable use

You agree not to:

  • Attempt to bypass security, spoof meters, reverse engineer unprotected parts of the Service, or disrupt operations.
  • Use the Service for fraud, electricity theft facilitation, or unlawful activity.
  • Abuse SMS, chat, or notification features, or harass support staff.
  • Scrape or overload APIs beyond normal app use.

6. Availability and accuracy

We aim for reliable service but do not guarantee uninterrupted connectivity. Meter readings, forecasts, and AI insights (including Lita) are informational aids and may be delayed, incomplete, or approximate. They do not replace official utility bills or legal notices unless your utility expressly says otherwise.

7. Intellectual property

The Service, branding, software, and content are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable licence to use the apps and sites for their intended purpose. You may not copy, modify, or redistribute them except as allowed by law or written permission.

8. Third-party services

Payments, SMS delivery, maps, hosting, and similar features may rely on third parties. Their terms and privacy practices apply to those components. We are not responsible for outages or acts of those providers beyond our reasonable control.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMERS ARE NOT ALLOWED.

10. Limitation of liability

To the fullest extent permitted by applicable law, we and our affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our aggregate liability for claims relating to the Service is limited to the amounts you paid through the Service for electricity top-ups in the three (3) months before the claim, or TZS 50,000, whichever is greater, except where liability cannot be limited by law (including for death or personal injury caused by negligence where such exclusion is unlawful).

11. Suspension and termination

We may suspend or terminate access if you breach these Terms, create security risk, or as required by the utility or law. You may stop using the Service at any time. Provisions that by nature should survive (including payments already processed, liability limits, and intellectual property) will survive termination.

12. Changes to the Terms

We may update these Terms periodically. The "Last updated" date will change when we do. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the United Republic of Tanzania, without regard to conflict of law rules. Courts in Tanzania have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.
